General Terms & Conditions (GTC)

Version: 09.10.2025 (extended for EU sales)


1. Scope

These General Terms & Conditions (GTC) govern the legal relationship between Lurdes Paulo (hereinafter "Seller") and customers (hereinafter "Customer") for all orders and deliveries via the Seller's online shop. Any deviating terms and conditions of the Customer shall not be recognised unless the Seller expressly agrees to their application in writing.

3. Offers, One-of-a-Kind Items & Product Presentation

3.1 All jewellery pieces are individual items or produced in very small runs. Minor variations in colour, shape, structure, and the grain of stones/metals are inherent to the materials and craftsmanship and do not constitute a defect.

3.2 The presentation of products in the online shop (photos, videos, texts, prices) constitutes an invitation to make an offer and is not a legally binding offer. Prior sale reserved.


4. Order Process & Contract Formation

4.1 By completing the checkout process, the Customer submits a binding offer to purchase the items in the shopping cart.

4.2 The contract is concluded only upon receipt of an order confirmation by e-mail. The automatic acknowledgement of receipt does not constitute acceptance.

4.3 The Seller may decline orders without stating reasons; any payments already made will be refunded in full in such cases.


5. Prices, Taxes (CH & EU), Shipping Costs & Payment Methods

5.1 All prices are displayed in CHF. For deliveries to EU countries, country-specific VAT rates are shown at checkout; final prices including VAT are displayed before purchase is completed.

5.2 EU deliveries: For shipments of EUR 150 or less, IOSS processing may be used where applicable; otherwise, import VAT and any customs duties will be collected by the carrier. Shipments above EUR 150 are subject to standard customs and tax procedures; any applicable charges are borne by the Customer.

5.3 In addition to the product price, shipping and insurance costs apply as shown at checkout.

5.4 Accepted payment methods: [credit card, TWINT (CH only), advance payment, etc.]. Payment is charged upon conclusion of the contract. For advance payment, the order is dispatched upon receipt of payment.


6. Delivery, Delivery Area & Transfer of Risk

6.1 Delivery area: Switzerland, Liechtenstein, and EU member states.

6.2 Delivery times are shown in the shop or stated in the order confirmation.

6.3 Shipments are sent insured to the address provided by the Customer. Risk transfers to the Customer upon handover of the goods.

6.4 Partial deliveries are permitted where reasonable. No additional shipping costs will be charged to the Customer as a result.


7. Retention of Title

The goods remain the property of the Seller until payment has been made in full.


8. Right of Withdrawal & Returns (CH & EU)

Switzerland & Liechtenstein: Swiss law does not grant a statutory right of withdrawal for online purchases. We offer a voluntary 14-day right of return for all customers. If you are not satisfied with your purchase, you may return it within 14 days of receiving the goods — no reason required. Exceptions: statutory warranty rights (Section 9) and transport damage.

EU Customers: For delivery addresses in EU member states, the statutory 14-day right of withdrawal applies to distance contracts. The period begins upon receipt of the goods. A clear declaration (e-mail/letter) or the model withdrawal form is sufficient; timely dispatch is adequate. If the required withdrawal information is not properly provided, the withdrawal period is extended accordingly.

Exceptions — No Right of Withdrawal (EU):

  • Items made to customer specification or clearly personalised (e.g. engravings, special sizes, bespoke pieces)
  • Sealed goods that are not suitable for return on grounds of health or hygiene where the seal has been removed after delivery (e.g. earrings/ear studs delivered sealed)
  • Damage or wear resulting from use beyond what is necessary to assess the nature, characteristics, and functioning of the goods

Returns & Costs (EU): Please notify us of your return within 14 days of declaring your withdrawal and send the item back sufficiently franked and insured in accordance with our instructions. Return shipping costs are borne by the Customer. We will refund the purchase price including standard shipping costs within 14 days of receiving the return or proof of dispatch.

Transport Damage (all countries): Please report any transport damage in writing within 5 days of delivery, including photos of the packaging and goods. Returns are only accepted after prior written authorisation (RMA). Carriage-unpaid parcels will not be accepted.

9. Statutory Warranty for Defects

9.1 Statutory warranty rights apply to defects caused by materials or manufacturing. The limitation period is two years from delivery.

9.2 The following do not constitute defects: normal wear and tear, patina formation, scratches from wearing, damage resulting from improper handling, lack of care, contact with chemicals (perfume, cosmetics, cleaning agents), impact, or moisture, as well as variations inherent to the nature of natural materials.

9.3 Defect procedure: The Customer must notify us of any defect in writing promptly upon discovery and return the item in accordance with our instructions. Following inspection, the Seller may choose to carry out repair or rectification. If repair is impossible or disproportionate (e.g. for unique pieces without replacement parts), the Seller will offer a price reduction or rescission of the contract with a full refund of the purchase price.


10. Care Instructions & Customer Responsibility

Customers are advised to follow the care instructions: protect jewellery from water, cosmetics, perfume, and cleaning agents; do not wear during sport, sleep, or showering; store dry and separately. Damage resulting from failure to follow these instructions does not give rise to warranty claims.


11. Liability

11.1 We are liable without limitation for intent and gross negligence, as well as for personal injury.

11.2 Liability for slight negligence is otherwise excluded. Mandatory statutory liability, in particular under the Swiss Product Liability Act (PrHG) and EU product liability law, remains unaffected.


12. Vouchers & Promotional Codes

Vouchers and promotional codes may be used once within the stated period, cannot be combined, are not redeemable for cash, and do not apply retrospectively.


13. Data Protection

Personal data is processed in accordance with the Seller's Privacy Policy and the requirements of the revised Swiss Federal Act on Data Protection (revFADP). The Privacy Policy is available at [URL].


14. Copyright & Intellectual Property

All content in the online shop (photos, videos, texts, designs) is protected by copyright. Any use beyond private purposes requires the prior written consent of the Seller.


15. Amendments to the GTC

We may amend these GTC at any time. The version published at the time of the order shall apply. Mandatory statutory consumer rights under EU law remain unaffected.


16. Severability

Should any provision of these GTC be wholly or partially invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by the applicable statutory rule.


17. Applicable Law, Dispute Resolution & Jurisdiction

Swiss law applies (excluding the UN Convention on Contracts for the International Sale of Goods, CISG). For consumers resident in the EU, the mandatory consumer protection provisions of their country of residence apply in addition; the courts with jurisdiction under the consumer's domestic law shall have competence. For merchants and businesses, the exclusive place of jurisdiction is the Seller's registered address.
