Privacy Policy

This Privacy Policy informs you about the processing of personal data by Lurdes Paulo (hereinafter "we"/"us") when visiting our website and making purchases in our online shop.

We comply with the revised Swiss Federal Act on Data Protection (revFADP) and — as we sell to the EU — the EU General Data Protection Regulation (GDPR).

2. Purposes of Processing & Legal Bases

We process personal data for the following purposes (GDPR legal bases in brackets):

Shop & Order Fulfilment Data: name, billing/delivery address, e-mail, order/payment data. Purposes: order processing, shipping, invoicing, accounting, customer communication. Legal bases: contract Art. 6(1)(b); legal obligation Art. 6(1)(c) (e.g. tax/commercial law); legitimate interest Art. 6(1)(f) (efficient fulfilment).

Customer Account (optional) Data: login credentials, order history, preferences. Legal bases: consent Art. 6(1)(a) or contract Art. 6(1)(b).

Communication & Support Data: content of enquiries, e-mail, timestamps, IP/metadata where applicable. Legal bases: Art. 6(1)(f); Art. 6(1)(b) for pre-contractual enquiries.

Newsletter & Marketing (optional) Data: e-mail, interaction data (opens/clicks), segments. Legal bases: consent Art. 6(1)(a); direct marketing to existing customers where permitted: Art. 6(1)(f). Withdrawal at any time via the unsubscribe link in the newsletter.

Security, Fraud Prevention & Logs Data: IP address, device/browser information, access timestamps, error messages. Legal basis: Art. 6(1)(f) (IT/data security, abuse prevention).

Web Analytics & Marketing Technologies (optional) Data: usage data, cookies/similar IDs, pseudonymous profiles. Legal bases: consent Art. 6(1)(a) (for statistics/marketing cookies); Art. 6(1)(f) for technically necessary measurements (where permitted under ePrivacy law).

Note: Our products are individual pieces and one-of-a-kind items; product photos do not contain personal data of buyers.

3. Mandatory Information

Information required for order processing is marked accordingly. Without it, a purchase cannot be completed.

4. Cookies, Similar Technologies & Consent

We use cookies and similar technologies:

  • Necessary cookies (e.g. shopping cart, checkout, security) — no consent required.
  • Statistics/marketing cookies — only with consent via the cookie banner; withdrawal possible at any time via the banner or browser settings.

Retention period: session to several months/years depending on cookie type.

We log consents (consent management) and provide a preference centre.

5. Recipients, Third-Party Providers & Data Processing Agreements

We use carefully selected service providers and conclude data processing agreements (Art. 28 GDPR / Art. 9 revFADP), including:

  • Hosting/CDN (e.g. Wix / cloud hosting / Infomaniak)
  • Payments (e.g. Stripe, Adyen, PayPal; TWINT for CH)
  • Shipping/logistics (e.g. Swiss Post, DHL)
  • Analytics & marketing (e.g. Google Analytics GA4, Meta Pixel / Meta Ads, TikTok Pixel, Pinterest Tag — only with consent)
  • Social media platforms (e.g. Meta/Instagram, TikTok, Pinterest) may receive data when you interact with our content or ads on their platforms. These providers operate under their own privacy policies and act as independent controllers for their own purposes.

Note on Swiss law (revFADP): We are subject to the revised Swiss Federal Act on Data Protection. Where we use third-party tools such as Meta (Facebook/Instagram), Google, or similar providers that may transfer data abroad (e.g. to the USA), we ensure appropriate safeguards are in place — such as standard contractual clauses or adequacy decisions recognised under Swiss law. 6. International Data Transfers

Where data is transferred to third countries (e.g. USA, UK, Israel), we ensure appropriate safeguards, such as EU Standard Contractual Clauses (SCCs), adequacy decisions, or additional technical and organisational measures (encryption, pseudonymisation). 7. IOSS, Taxes & Customs (EU Deliveries)

For shipments to the EU, import duties or taxes may apply depending on the order value. For orders of EUR 150 or less, IOSS processing may be used; otherwise the carrier will collect import VAT/customs duties. These rules do not affect data subject rights.

8. Retention Periods

We process data only for as long as necessary for the relevant purposes. Statutory retention obligations (e.g. tax and commercial law) remain reserved. Once purposes or retention periods have lapsed, data is deleted or anonymised.

9. Your Rights (GDPR Art. 15–22)

You have the right to access, rectification, erasure, restriction of processing, data portability, and to object to processing for direct marketing purposes. Consents may be withdrawn at any time with effect for the future.

10. No Automated Individual Decision-Making

We do not make decisions based solely on automated processing that produce legal effects or similarly significantly affect you. Profiling for marketing purposes, if any, is carried out only on the basis of your consent.

11. Data Security

We implement appropriate technical and organisational measures (TOMs) — including encryption, access controls, backups, need-to-know principles, and staff training — to protect data against loss, misuse, and unauthorised access.

12. Updates

We may update this Privacy Policy in response to legal, technical, or business changes. The version currently published applies; we will provide appropriate notice of material changes.
